43 RCNY Chapter 14, Subchapter 7 ((E) Designation and Environmental Restrictive Declaration Program)
Administered by the NYC Office of Environmental Remediation (OER), this program governs tax lots carrying an (E) designation or a recorded environmental Restrictive Declaration for hazardous materials, air quality, or noise, established through CEQR environmental review of zoning actions. For hazardous-materials sites, the owner or developer must complete an OER-approved environmental investigation (including a Phase II site assessment) and an OER-approved Remedial Action Plan; DOB cannot issue the building permit needed for the work until OER issues a Notice to Proceed, and cannot issue a temporary or final certificate of occupancy until OER issues a Notice of Satisfaction confirming all environmental requirements are met.
