N.Y. Energy Law Article 11 (§§ 11-101 to 11-110) — State Energy Conservation Construction Code Act
Energy Law Article 11 is the enabling statute for New York's State Energy Conservation Construction Code. Section 11-103 gives the State Fire Prevention and Building Code Council exclusive authority among state agencies to promulgate a construction code incorporating energy-conservation and clean-energy features, superseding conflicting codes of other state agencies. Section 11-104 sets the design criteria the code must meet and, as amended by 2023 legislation (the "All-Electric Buildings Act"), directs the code to prohibit fossil-fuel equipment and building systems in most new buildings of seven stories or less on or after December 31, 2025 and in all new buildings after December 31, 2028 (with statutory exemptions), and to require electric-vehicle-ready infrastructure and charging stations for new buildings with off-street parking in any code adopted after December 31, 2026.
