EV-Ready Infrastructure Mandate (Energy Law 11-104)
N.Y. Energy Law § 11-104 (electric-vehicle-ready infrastructure / EV charging station provision for new construction)
N.Y. Energy Law § 11-104 directs that when the State Fire Prevention and Building Code Council adopts a new State Energy Conservation Construction Code after December 31, 2026, that code must require any new building with associated new off-street parking to provide electric-vehicle-ready infrastructure and electric vehicle charging stations. For occupancies other than detached one- and two-family dwellings, the council must set minimum numbers of parking spaces with EV-ready infrastructure, minimum numbers with charging stations, and minimum charging-capacity standards. The requirement applies prospectively to new buildings only and expressly does not apply to existing buildings or their repair, alteration, addition, relocation, or change of occupancy.
