N.Y. Real Property Law § 234
Whenever a residential lease lets the landlord recover attorneys' fees and/or expenses incurred as a result of the tenant's failure to perform a lease covenant, the statute implies a reciprocal covenant that the landlord must pay the tenant's reasonable attorneys' fees and/or expenses incurred when the landlord fails to perform its own lease obligations or when the tenant successfully defends an action or summary proceeding brought by the landlord. Any waiver of this section is void as against public policy.
