N.Y. Labor Law § 241 (incl. subd. 6)
Requires that all areas where construction, excavation, or demolition work is performed be constructed, shored, equipped, guarded, arranged, operated, and conducted so as to provide reasonable and adequate protection and safety to persons employed there or lawfully frequenting the area. Subdivision 6 directs the Commissioner of Labor to make rules implementing this requirement (the Industrial Code, 12 NYCRR Part 23) and obligates contractors, owners, and their agents to comply, except owners of one- and two-family dwellings who contract for but do not direct or control the work; New York courts treat a violation of a sufficiently specific Industrial Code provision as a basis for owner/contractor liability without regard to their supervision or control of the work.
