12 NYCRR Part 23 (Industrial Code Rule No. 23)
New York's detailed construction-safety regulation (Industrial Code Rule No. 23), promulgated by the Commissioner of Labor and applicable throughout New York State. It sets concrete, often OSHA-stricter requirements across construction, demolition, and excavation work — including fall protection and guarding of hazardous openings (§23-1.7), scaffolds, ladders and ladderways (§23-1.21), excavation and trench work, demolition, material and personnel hoisting, electrical-hazard protection (§23-1.13), drowning-hazard rescue equipment (§23-1.7(c)), and personal protective equipment. Because many of its provisions are specific positive commands rather than general safety standards, their violation can support owner/contractor liability under Labor Law §241(6).
