9 NYCRR § 466.13
Adopted by the NYS Division of Human Rights effective January 20, 2016 (amended, NYS Register June 24, 2020) under Executive Law § 295.5, this regulation establishes that gender identity or expression is a protected category and that discrimination on that basis is unlawful in all areas of jurisdiction covered by the Human Rights Law, including housing. It provides that discrimination based on gender identity or expression, including the status of being transgender, is also sex discrimination, and that gender dysphoria (or other condition meeting the Human Rights Law definition of disability) is a disability — so refusing a requested, necessary reasonable accommodation constitutes disability discrimination.
