CWA Section 404 Dredge/Fill Permits

33 CFR Part 323

Implements the U.S. Army Corps of Engineers permit program under Clean Water Act Section 404 (33 U.S.C. 1344), which requires a Department of the Army permit before dredged or fill material may be discharged into waters of the United States, including wetlands, unless the discharge is exempt under 33 CFR 323.4. Discharges may be authorized through individual permits, nationwide permits (33 CFR Part 330), or regional permits issued by district or division engineers.
