BSA Special Permit Findings (ZR 73-03)

NYC Zoning Resolution §73-00 et seq.; §73-03 (General Findings Required for All Special Permit Uses and Modifications); 2 RCNY Ch. 1

ZR §73-03 sets the general findings the Board of Standards and Appeals must make to grant any special permit use or modification of use, parking or bulk regulations, including that the hazards or disadvantages to the community are outweighed by the advantages and that adverse effects on privacy, quiet, light and air are minimized by appropriate conditions. The Board must deny a special permit whenever the proposed use or modification will interfere with any public improvement project approved by or pending before the Board of Estimate, Site Selection Board, or City Planning Commission. Special permit uses within the BSA's jurisdiction are set forth in ZR §73-10 et seq.
