12 NYCRR Part 56 (Industrial Code Rule 56)

Industrial Code Rule 56 (12 NYCRR Part 56) governs protection of public and worker safety and health during the removal, encapsulation, enclosure, repair, or disturbance of friable and non-friable asbestos, or any handling of asbestos material that may release asbestos fibers. It requires the owner to obtain an asbestos survey before any building or structure demolition, renovation, remodeling, or repair to determine the presence of asbestos-containing material (ACM, defined as material containing greater than one percent asbestos); where impacted ACM is found, abatement must be completed by a DOL-licensed asbestos abatement contractor before such work may commence. The rule also prescribes abatement work practices, agency and local-permitting notifications, variances, and air sampling/monitoring, and is enforced by the NYS DOL Asbestos Control Bureau.
