12 NYCRR Part 56 (Industrial Code Rule 56); Labor Law Article 30 (§§ 900–910)

Industrial Code Rule 56 (12 NYCRR Part 56), promulgated by the NYS Department of Labor under Labor Law Article 30 (the asbestos licensing and abatement statute), governs the removal, encapsulation, enclosure, repair, or disturbance of friable and non-friable asbestos. Before any demolition, renovation, remodeling, or repair of a building or structure (with limited exemptions, such as agricultural buildings and structures begun after January 1, 1974), the owner or owner's agent must obtain an asbestos survey performed by a certified NYS asbestos inspector (12 NYCRR 56-5.1). If asbestos-containing material is present and would be impacted, it must be abated by a licensed asbestos abatement contractor, with project notification, before other work proceeds.
