6 NYCRR Part 496 — Statewide Greenhouse Gas Emission Limits (ECL § 75-0107)

6 NYCRR Part 496, adopted by the NYS DEC effective December 30, 2020 to implement ECL § 75-0107 of the Climate Leadership and Community Protection Act, establishes the statewide greenhouse gas emission limits: 60% of 1990 levels by 2030 and 15% of 1990 levels by 2050, measured against an estimated 1990 baseline of 409.78 million metric tons of CO2-equivalent using a 20-year global warming potential (GWP20). This yields limits of 245.87 MMT CO2e in 2030 and 61.47 MMT CO2e in 2050. The rule sets statewide accounting limits applicable to State agencies, programs, and planning documents that drive downstream CLCPA sector regulations rather than imposing direct facility-level obligations.
