P.L. 2018, c.17 (N.J.S.A. 48:3-87.10; C.48:3-87.8 et al.)
New Jersey's Clean Energy Act of 2018 (P.L. 2018, c.17), codified at N.J.S.A. 48:3-87.10, directs the Board of Public Utilities to require the owner or operator of each commercial building over 25,000 square feet to benchmark its energy and water use for the prior calendar year using the U.S. EPA's Portfolio Manager tool. The BPU approved the implementing Energy and Water Benchmarking Program by order on September 7, 2022, with the first reporting deadline (for 2022 consumption data) on October 1, 2023 and subsequent annual deadlines on July 1; a "4/50" rule aggregates whole-building utility data to protect tenant privacy.
