Phase I Environmental Site Assessment
A Phase I ESA is typically the first step in environmental due diligence. It involves:
- Historical research: Reviewing historical maps, city directories, and records to identify past uses that may have caused contamination
- Database review: Searching federal, state, and local environmental databases for known contamination sites
- Site reconnaissance: Physical inspection of the property and surrounding area
- Interviews: Speaking with current owners, occupants, and local officials
A Phase I ESA typically costs $2,000-$5,000 and takes 2-4 weeks. It does NOT involve soil or groundwater testing.
Phase II Environmental Site Assessment
If the Phase I identifies potential contamination (Recognized Environmental Conditions or RECs), a Phase II involves actual testing:
- Soil sampling and analysis
- Groundwater monitoring wells
- Soil vapor testing
- Asbestos and lead paint surveys
Phase II costs range from $10,000 to $100,000+ depending on the scope of investigation needed.
E-Designations
NYC assigns E-designations to properties that may have environmental concerns based on their zoning or historical use. An E-designation requires:
- Environmental investigation before any building permit is issued
- Remediation if contamination is found
- A Restrictive Declaration recorded against the property
E-designations are common in former manufacturing zones that have been rezoned for residential use (like parts of Williamsburg, Long Island City, and Gowanus).
NYC Brownfield Programs
NYC and NYS offer brownfield cleanup programs that provide tax credits and liability protection for voluntary cleanup of contaminated properties:
- NYC Voluntary Cleanup Program (VCP): Administered by OER, provides oversight and closure letters
- NYS Brownfield Cleanup Program: Provides tax credits of 10-22% of eligible cleanup costs
